GENERAL TERMS AND CONDITIONS
1.- GENERAL ASPECTS
These General Terms and Conditions (GT&Cs) expressly govern any commercial relationship arising between HOTEL LAS RAMPAS - FRABAT, S.A. (hereinafter HOTEL LAS RAMPAS) and any users or customers contracting services offered via the website www.hotellasrampas.com
They have been drawn up in accordance with the regulations in force in this matter, and specifically in accordance with the terms of the following legal texts:
• Information Society and Electronic Commerce Services Act 34/2002.
• General Contractual Conditions Act 7/1998.
• Royal Decree 1906/1999, governing telephone or electronic contracts with general conditions, in development of Article 5.3 of Act 7/1998.
• General Consumer and User Protection Act 26/1984.
• Retail Trade Regulation 7/1996.
• Electronic Signature Act 59/2003, of 19 December 2003.
Both browsing and the contracting of the services offered by HOTEL LAS RAMPAS constitute acceptance as a User, without any form of reservation, of each and every one of the following GT&Cs and, as applicable, the Individual or Specific Conditions.
HOTEL LAS RAMPAS may at any time, without prior notice, modify these GT&Cs and the Individual Conditions that they might include, by means of publication of said modifications on the WEBSITE itself, in order to inform users and allow them once again to accept them.
2.- PRE-CONTRACTUAL INFORMATION
Users, by accepting these GT&Cs, declare that they are of legal age and enjoy the necessary legal standing in order to use this website in accordance with the General Conditions here set out, which they understand and comprehend in their entirety.
Once the service has been contracted, Users will see the acceptance of the booking displayed online by means of the verification screen, as confirmation of the contract entered into.
Confirmation of the booking and confirmation of payment for it (printed off by the user) will not be deemed valid as an invoice.
3.- FORMALISATION OF THE PURCHASE
3.1.- SERVICES OFFERED. INDICATION OF PRICES
HOTEL LAS RAMPAS will at all times show the services offered together with their inherent characteristics and their price.
HOTEL LAS RAMPAS reserves the right to decide at any time the services offered to users or customers via the website www.hotellasrampas.com
As a result, HOTEL LAS RAMPAS may at any time add new services to those included therein, which shall be governed by the terms of the General Conditions in force at that time. HOTEL LAS RAMPAS likewise reserves the right no longer to provide access, at any time and without prior notice, to any of the services offered.
3.2.- INDICATION OF PRICES OF THE SERVICES
The price of each service will appear on screen.
The prices on screen will be indicated in Euros and include the corresponding value added tax (VAT), and any other tax that might apply. The prices indicated on screen will at all times be the current prices, excluding typographical errors.
3.3.- AVAILABILITY
The availability of each service will depend on the calendar provided by the Hotel.
4.- PAYMENT FOR THE SERVICE
Non-reimbursable rate: Hotel Las Rampas (Frabat, S.A.) will charge the full amount of the booking to the credit card authorised by the customer at the time of confirmation.
Online rate: the full amount for the booking will be paid directly at Hotel Las Rampas (Frabat, S.A.) upon arrival of the customer, unless otherwise indicated during the contractual process. During dates of high occupancy, the establishment will charge 100% of the amount corresponding to the first night at least 2 days in advance of the date of arrival. This deposit will be deducted from the full amount payable.
5.- HOTEL CANCELLATION POLICY
Non-reimbursable rate: as this is a "non-reimbursable" rate, in the event of a cancellation or no-show by the customer, the customer will not be entitled to any refund of any amount by Hotel Las Rampas (Frabat, S.A.).
Online rate: if the booking is cancelled or modified up to 48 hours in advance of the date of arrival, Hotel Las Rampas (Frabat, S.A.). will levy no charges. If the booking is cancelled or modified beyond this period or if the client fails to show, the establishment will charge 100% of the amount corresponding to the first night.
6.- PROTECTION OF PERSONAL DATA
HOTEL LAS RAMPAS is particularly concerned with the security and confidentiality of the data provided by its customers. HOTEL LAS RAMPAS undertakes in this regard to protect the personal data of users of the website www.hotellasrampas.com
The personal data protection policy extends to all aspects regarding the gathering and use of information provided via this WEBSITE. (See Privacy Policy.)
If any changes occur in the Data Protection Policy set out, users will be duly informed via this WEBSITE.
7.- APPLICABLE LAW. ACCEPTANCE OF LEGAL FORUM
This contract will be governed by Spanish law, which will apply in all particulars not provided in this contract as regards interpretation, validity and execution.
The parties expressly waive any other legal forum to which they might have been entitled, and expressly accept the authority of the courts of Malaga for the resolution of any disputes that might arise out of the interpretation or execution of these contractual conditions.
